REGULAR MEETING

 

A regular meeting of the Board of Trustees of the Village of Trenton, NE, was convened in open and public session, Tuesday, June 13, 2017 at 6:30 p.m. at the Village Office.  Present:  Chairman McArthur, Trustees Lewis (arrived at 6:45pm), McDonald, and Neely, Clerk McKain, Deputy Clerk Rife, Attorney Lindstedt, Superintendent Vrbas, Bob Brown, Julia Bryant, Larry Evans, Terry Hovey, Colleen McVicker, Bob Seybold, Merlin Shaffer, and Karen Wertz.  Trustee Wimer was absent.  Availability of the agenda was communicated in advance notice and in the notice sent to the Chairman and Trustees of the meeting. All proceedings hereafter shown were taken while the meeting was open to the public.

 

Roll Call was taken at 6:33pm and quorum was verified.

 

Chairman made “Open Meeting Act” announcement.

 

Citizen Forum:  Mr. Seeker was not present; however, he complained about Circle Drive lots and had stated the lots were being worked on.  Mr. Brown inquired about nuisance properties, McArthur stated a discussion is on the agenda.  Mr. Seybold had an issue with the shooting sports on clean-up day and felt there was a safety issue.  Mr. Shaffer stated he has met with other instructors and shooting sports will work around clean-up day to avoid a conflict.  Mr. Shaffer stated there is a conflict with July 1; therefore the board decided to have clean-up day July 1 and 2 from 1pm to 6pm on both days.  Notices will be placed at the bank, post office, tree branch site and village office. Mr. Huddleson wanted to inquire about nuisance abatement and ordinances; however, he did not attend.  Mr. Hovey inquired about the man power being utilized effectively.  Mr. Hovey said the water project had damaged his property; however, it has been fixed now.  Mr. Hovey asked that fire hydrants be mowed around so they are visible to the firefighters.  Mr. Hovey asked that culverts be cleaned and maintained on a regular basis.  Mr. Hovey inquired about the compaction report on West B Street to ensure that semi-trucks would not damage the street.  Mr. Hovey asked that farm trucks and semi-trucks with loads for the co-op utilize the old highway and the trail leading to the grain bins at Wertz’s.  Mr. Hovey asked that the sheriff’s office slow people down on highway 25 going through town.  Mr. Hovey stated the village building is not ADA compliant and is a drainage hazard.  Mr. Hovey asked that some notices be on the utility bills for residents.  Mr. Hovey asked the board to clean-up properties.  Mr. Hovey stated the sewer-jet should be used to flush out lines on a regular basis.  Mr. Hovey suggested that water and sewer lids be painted.  McArthur stated the board is working with residents on clean-up, he is to the understanding that West B Street has 8-9 inches of concrete, he would speak with Wertz about road, maintenance schedules were being worked on, and lids were beginning to be painted blue for water and green for sewer.

 

Motion made by McDonald and second by Neely to approve agenda. Ayes: Lewis, McArthur, McDonald, and Neely.  Nays: None.  Absent: Wimer.  Motion carried.

 

Motion made by Lewis and second by McDonald to approve the May 9, 2017 regular meeting minutes.  Ayes: Lewis, McArthur, and McDonald.  Nays: None.  Abstain: Neely.  Absent: Wimer.  Motion carried.

 

Motion made by Lewis and second by McDonald to approve treasurer’s report.  Ayes: Lewis, McArthur, McDonald, and Neely.  Nays: None.  Absent: Wimer.  Motion carried.

 

Park/Pool Committee Report: McDonald stated the park needed more weed eating.  Ms. Wertz stated the park was looking very nice.

 

Utility/Street/Trash Committee Report: Discussion was made on properties that need to be cleaned up.  McDonald stated the free clean-up on June 3rd was limited due to weather and volunteers.  McDonald stated he would like to see more volunteers from the community.  McArthur stated the village will host another free clean-up day on July 1 and 2, 2017 from 1pm to 6pm both days.  Discussion was made to move the clean-up day in August due to Harvest Festival.  It was decided that clean-up day would be August 12th and 13th

 

Attorney Report: Lindstedt stated they had worked on the solar power ordinance, which is on the agenda for approval.

 

Utility Superintendent Reports:  Electric Department: Vrbas stated there were two street lights out and they would be getting those replaced.  Ms. Wertz stated the outlets on the south pole at the pow-wow grounds were not working.  Vrbas stated he was not aware of an issue and would check on it.  Water Department: Vrbas stated there is no hurry to install the water meter pit for Williamson.  Sewer Department:  Vrbas reported Johnson would be here in mid July for sewer maintenance.  Trash Department: Vrbas reported they are using both trash trucks; however, the newer truck has some issues with the wiring harness.  Several dumpsters have been an issue for residents.  Street Department: Armor coating took place.  A request for a culvert on East A was made.  Vrbas is to contact the property owner that fence is a problem to maintain water flow.  Park Department: Vrbas stated they have been hand sprinkling one area as the sprinkler system is not getting it.  Vrbas reported that some new trees were possibly damaged with the snow storm and will continue to monitor the trees.  Pool Department:  Vrbas stated the pool is running smoothly.

 

Animal Control: Vrbas reported there are 18 cats and 136 dogs licensed for 2017.  No warnings or citations were issued for the month of May.

 

Village Office:  McKain stated there was one meter deposit to return this month.  McKain stated they would be reading meters June 21-23.  McKain stated she would be attending the LONM Accounting and Finance conference on June 14-16 in Kearney.

 

Library:  Evans stated the library is looking at some promotional items for Harvest Festival.

 

Planning Commission: Evans stated the Planning Commission had two public hearings for conditional uses.  Motion made by Neely and second by Lewis to approve the conditional use application for 201 East 2nd Street.  Ayes: Lewis, McArthur, McDonald, and Neely.  Nays: None.  Absent: Wimer.  Motion carried.  Motion made by Neely and second by Lewis to approve the conditional use application for 602 East G Street.  Ayes: Lewis, McArthur, McDonald, and Neely.  Nays: None.  Absent: Wimer.  Motion carried.  Evans stated the Planning Commission approved Mr. Heffner to fill the vacant position with a term ending August 31, 2018.  Motion made by Neely and second by McDonald to approve Mr. Heffner to fill the vacant position with a term ending August 31, 2018.  Ayes: Lewis, McArthur, McDonald, and Neely.  Nays: None.  Absent: Wimer.  Motion carried.

 

El Dorado: McDonald asked about parking lot holes being repaired.  Vrbas was instructed to get patch materials and fix holes. Lindstedt reported the EEOC case was closed as violations were unfounded.  McArthur reported the El Dorado Board had interviewed one applicant.  McArthur stated the heating/cooling system has had several breakdowns and asked McKain to contact Linda Cook for details and then contact W Design.

 

Housing Authority: No information provided.

 

Tree Board: Wertz stated she did plant a tree at the courthouse for Arbor Day.

 

Board of Health: McArthur stated a complaint was made on burning at a residence on West 4th Street.  Employees checked the area and found no burning or smoke and will continue to patrol area.  It was also reported another resident was burning, which employees were instructed to monitor that area as well.

 

Unfinished Business:  There was no unfinished business to discuss.

 

Ordinance and/or Resolution: Vice-Chairman Neely introduced Ordinance No. 805. After the reading of the ordinance, Vice-Chairman Neely made a motion which was seconded by Trustee Lewis to suspend the statutory reading of the ordinance on three separate days. Ayes: Lewis, McArthur, McDonald, and Neely.  Nays: None.  Absent: Wimer.  Motion carried.  Motion by Neely with second by Lewis to pass and adopt Ordinance No. 805 on final reading. Ayes: Lewis, McArthur, McDonald, and Neely. Nays: None.  Absent: Wimer.  Motion carried. A true copy follows:

AN ORDINANCE OF THE VILLAGE OF TRENTON, WHICH DEFINES SOLAR ENERGY; and TO PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.

Vice-Chairman Neely introduced Ordinance No. 806. After the reading of the ordinance, Vice-Chairman Neely made a motion which was seconded by Trustee McDonald to suspend the statutory reading of the ordinance on three separate days. AN ORDINANCE AMENDING §51.08 MANDATORY SERVICE CHARGES OF THE MUNICIPAL CODE RELATING TO SOLID WASTE COLLECTION WITHIN THE VILLAGE OF TRENTON, AND FEE CHARGED FOR SUCH SERVICE; PROVIDING AN EFFECTIVE DATE, AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH.

 

Motion by Neely with second by McDonald to publish Ordinance No. 806 in pamphlet form. Ayes: Lewis, McArthur, McDonald, and Neely.  Nays: None.  Absent: Wimer.  Motion carried.

 

Motion by Neely with second by Lewis to approve Resolution 2017-06-01 for the adoption of a Solar Energy Policy and Procedure.  Ayes: Lewis, McArthur, McDonald, and Neely.  Nays: None.  Absent: Wimer.  Motion carried.

 

RESOLUTION # 2017-06-01

 

BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF TRENTON, HITCHCOCK COUNTY, NEBRASKA

 

 

WHEREAS, the Municipal Energy Agency of Nebraska (MEAN) recommends adoption of an interconnection policy for renewable energy resources; and,

 

WHEREAS, the Village of Trenton supports renewable energy; and,

 

WHEREAS, the Village of Trenton has determined such interconnection policy as recommended and provided by MEAN is in the best interests of the Trenton electric utility and the citizens of Trenton; and,

 

WHEREAS, the Village of Trenton’s electric utility department will administer such interconnection policy.

 

NOW, THEREFORE, BE IT RESOLVED, by the Village Board of Trustees of the Village of Trenton, Hitchcock County, Nebraska, as follows:

 

1. Effective July 1, 2017, the Trenton Village Board has adopted the Policy and Guidelines for Interconnection for Parallel Installation and Operation of Small (25 kW-DC or less) and Large (greater than 25 kW-DC) Customer-Owned Renewable Electric Generating Facilities.

RESOLUTION 2017-06-02

Special Event Closing of Highway 25 for Harvest Festival

 

The Board Chairman and Village Board of Trustees of the Village of Trenton (hereinafter in the Village), in regular session assembled at the Village Office in Trenton, Nebraska on the 13th day of June, 2017, hereby resolve as follows:

 

WHEREAS, the Village will assume control of Highway 25 (Main Street) between West G Street and West B Street on August 5, 2017 from 11:00 a.m. to 12:30 p.m.

 

WHEREAS, the Village acknowledges the acceptance of the duties set out in LB 589 subsection (2) and is in agreement to indemnify, defend, and hold harmless the state from all claims, demands, actions, damages and liability, including reasonable attorney’s fees, which may arise as a result of the special event.

 

NOW THEREFORE BE IT RESOLVED that the Village will assume control of Highway 25 (Main Street) between West G Street and West B Street beginning at 11:00 a.m. on August 5, 2017.

 

NOW THEREFORE BE IT FURTHER RESOLVED that the Village will return possession back to the State of Nebraska Department of Roads Division (NDOR) at 12:30 p.m. on August 5, 2017.

New Business: Ms. Wertz asked that the board consider a donation for the Harvest Festival to the Trenton Rec. Association.  Motion made by Neely and second by Lewis to approve a $300 donation from Keno funds. Ayes: Lewis, McArthur, McDonald, and Neely.  Nays: None. Absent: Wimer.  Motion carried.  Discussion was made on the Menards Authorized users for the Kearney location.  A discussion and review of the NMPP Amended Electrical Resources Agreement was made.  A discussion was made on having Southwest Nebraska Betterment Community write and submit a grant application CDBG.  After the discussion a motion by Neely with second by Lewis to approve SWNCBC to write and submit the grant application for a fee of $2,500.  Ayes: Lewis, McArthur, McDonald, and Neely.  Nays: None.  Absent: Wimer.  Motion carried.  Motion made by Neely and second by Lewis to enter into executive session for the purpose of discussing evaluations of job performance of a person when necessary to prevent needless injury to the reputation of a person and if such person has not requested a public meeting at 8:17pm.  Ayes: Lewis, McArthur, McDonald, and Neely.  Nays: None.  Absent: Wimer.  Motion carried.  Motion made by Lewis and second by McDonald to exit the executive session at 9:10pm. Ayes: Lewis, McArthur, McDonald, and Neely.  Nays: None.  Absent: Wimer.  Motion carried.  Motion made by Neely and second by Lewis to increase the following wages: Clerk/Treasurer, Deputy Clerk/Treasurer, Utility Superintendent, Maintenance person, and trash/mowing person by 3% per hour effective beginning with the June 12th pay period.  Ayes: Lewis, McArthur, McDoanld, and Neely.  Nays: None.  Absent: Wimer.  Motion carried.
